THE ISSUES:

Some of the questions to be addressed:

  • How can employees prove the existence of an "invisible" chronic disease? How can employers identify when the employee is genuinely suffering from a chronic, debilitating disorder? Can employers require examination by the employer's own doctor or psychiatrist?

  • What is the extent of an employer's duty of accommodation? When do an employee's needs constitute "undue hardship"?

  • Where benefits are denied by a third party insurer, what remedies are available to claimants at arbitration? When are employers directly liable?

  • Can an employer discipline/discharge an employee for absenteeism related to chronic illness?
