Some of the questions to be addressed:

  • Can employers monitor employees' internet and e-mail usage? Do employees have a reasonable expectation of privacy in relation to workplace e-mail?

  • By using employer equipment for private communication, do employees implicitly consent to monitoring?

  • Are employees' privacy rights limited if they are given notice that computer usage is monitored?

  • What constitutes internet e-mail abuse, and when does it warrant discipline?

  • What impact, if any, does the constant monitoring of work and work habits have on employees?

  • What approaches have arbitrators adopted toward the admissibility of evidence obtained through computer monitoring?

  • What impact does recent privacy legislation (e.g. PIPEDA) have on employees' use of e-mail and internet at the workplace?

  • In defining the scope of privacy rights, is there a difference in the attitudes of courts, privacy commissions and arbitrators? What tests do they apply?

  • What polices and best practices have employers adopted in dealing with e-mail and internet use?
