THE ISSUES:

Some of the questions to be addressed:

  • Are last chance agreements consistent with the duty to accommodate? Do they constitute an effective accommodation strategy, whether legally binding or not?

  • In cases of addiction, should a last chance agreement allow for relapses? Does an agreement that does not allow for relapses constitute discrimination?

  • Are last chance agreements binding following transfer to a new employer?

  • In what circumstances will arbitrators interfere with last chance agreements?

  • Is a requirement for average attendance in a last chance agreement legally valid or does it constitute discrimination? In calculating average attendance, can non-culpable absences (e.g. due to disability) be counted?
