THE ISSUES:

Some of the questions to be addressed:

  • In light of the Supreme Court's ruling in Parry Sound, are all legislated human rights obligations now part of the collective agreement? Or only those obligations which have some nexus or foundation in the agreement?

  • What elements should form part of a "best practices" clause dealing with human rights and accommodation?

  • Do clauses prohibiting discrimination in collective agreements implicitly allow an employer to invoke a BFOQ defence (that the rule or requirement complained of is a bona fide occupational qualification)?

  • Where discrimination is not defined in the collective agreement, does it have the same meaning as in human rights legislation? E.g. does it include the obligation to protect employees from harassment?

  • Do requirements for attendance at work — as a condition of entitlement to leaves, seniority accrual, benefits — violate the guarantee of equality in human rights legislation?

  • When will union and employers be held liable for a breach of human rights provisions? What can they do to limit or avoid liability?

  • How do courts, tribunals, and arbitrators measure damages for violations of human rights legislation?
