THE ISSUES:

Some of the questions to be addressed:

  • Can an employer breach the collective agreement in order to accommodate an employee?

  • In what circumstances do unions have to waive seniority provisions in order to meet the duty to accommodate?

  • When do the negotiated seniority rights of other employees outweigh the duty to accommodate?

  • Does the duty to accommodate require an employer to delay filling a position until the senior employee has recovered from a disability?

  • If no appropriate jobs exist within the bargaining unit, are employers obligated to accommodate an employee by placing him or her in a non-bargaining unit position? Can employers hold such positions in reserve?

  • Do experience-based seniority systems discriminate against disabled employees? If so, how should this be corrected?

  • How can unions, employers, and arbitrators develop a framework to reconcile seniority and the right not to be discriminated against?
