THE ISSUES:

Some of the questions to be addressed:

  • What tools do employers use to identify, screen, and determine the suitability of employees?

  • What kinds of screening/background checks are appropriate? Can employers request spousal/parental information? Credit, employment, and educational history?

  • What are courts, arbitrators and privacy commissions saying about the scope of privacy rights in the context of screening?

  • When are health and fitness tests acceptable and when are they discriminatory?

  • Under what conditions is drug and alcohol testing appropriate at the pre-employment stage? During employment? When are random drug and alcohol tests permitted? When does testing positive for drugs justify discipline? And when does it require accommodation?

  • Is off-duty consumption of drugs or alcohol a legitimate concern of the employer sufficient to justify testing? Discipline?

  • What are the latest technologies in "bio" screening, and in what circumstances is their use at the workplace permitted?

  • What less privacy-invasive options are available for testing employees?
