THE ISSUES:

Some of the questions to be addressed:

  • What measures are required by the duty to accommodate employees who have responsibilities arising out of their "family status"? What relationships are included under "family status"?
  • Does the duty to accommodate require an employer to modify an employee's work schedule to facilitate child-care obligations? Caring for aging parents?
  • When must family emergency/responsibility leave be granted, and when can it be denied? To which workers does it apply?
  • What "best practices" exist with respect to accommodation of employees' family obligations? What clauses have been negotiated in collective agreements?
  • What rights do adoptive parents have versus biological parents?
  • What are the rights of employees on their return to work following parental/pregnancy leave? What should the employer do if the employee's job no longer exists and there is no comparable position?
  • Is absence due to complications or post-partum depression covered by maternity leave or sick leave? How much medical information is the employer entitled to in a post-delivery medical certificate?
  • What minimum labour standards apply in respect of compassionate care leave, and how do they mesh with Employment Insurance benefits? What are the limits of these benefits?
  • What is the impact of parental or family leave on vacation entitlement? On benefits? On seniority? On job postings? On accrual of pension benefits?
