| THE
ISSUES: | Some
of the questions to be addressed: - In
what circumstances does an employer have a legitimate interest in an employee's
off-duty conduct? What factors do arbitrators apply in determining this issue?
Are employers ever liable for employees' off-duty conduct?
- In
cases of addiction, can employers limit or prohibit an employee's use of drugs
or alcohol after work hours? Does it make a difference if the employee is a drug
addict or a recreational user? Can a condition of abstinence be included in a
"last chance" agreement?
- Can
employees be disciplined for views expressed outside the workplace that reflect
adversely on the employer?
- Do
certain employees, such as teachers or public employees, have a higher responsibility
for their off-duty conduct?
- In
what circumstances can an employee be suspended pending a trial on criminal charges?
When is the employer required to maintain the employee in his or her job, or another
accommodated job, pending the result of the trial?
- When
is an employee's conviction for off-duty criminal conduct cause for discharge?
Is incarceration a cause for dismissal, or is the employer required to grant an
employee leave to serve a criminal sentence? Can an employee be discharged for
failure to report to work where the employee was awaiting bail or was remanded
in custody?
- Is
surveillance of employees outside the workplace permissible? If so, in what circumstances?
- Should employers
develop policies regarding off-duty activities? If so, what provisions should
be included?
