THE ISSUES:

Some of the questions to be addressed:

  • Wind-up and termination of pension plans: When? How? By whom? With what consequences for distribution? Who is entitled to pension surpluses - the employer or the employees?
  • What legislative changes are likely to be made to federal and provincial pension legislation? On pension funding? Access to surplus, etc.?
  • What consequences can we expect from the growing number of pension plans that are in deficit? What happens to the pension plan if the employer becomes insolvent or bankrupt? Is a pension benefit guarantee fund an appropriate option?
  • Are the days of defined benefit pension plans numbered?
  • What powers do pension trustees have to change or reduce pension benefits, or alter their allocation among beneficiaries? What responsibilities do trustees have to provide full disclosure to plan members?
  • Can unions bargain for retirees? Are they obliged to do so? Where is the balance to be struck between the priorities of younger versus older workers?
  • How are unions and employers dealing with the rising cost of retiree benefits?
  • Can pension plans differentiate based on age in the face of legislation ending mandatory retirement?
