THE ISSUES:
  • What are the emerging issues in contract negotiations between employers and unions? What benefits are being sought by employees and how are these demands being balanced against the needs of employers to reduce costs and maintain efficiency?
  • What is the latest in contractual language relating to compensation (including bonuses and incentives, profit and gain sharing, market supplements, merit pay, readjustment, retention adjustments, etc.)?
  • How are the parties addressing, in contract language, issues relating to accommodation of disabilities, such as chronic illness, drug and alcohol addiction?
  • With civil suits for harassment and bullying on the rise, and damages awards for these violations climbing at arbitration, what contractual innovations in the area of workplace violence and harassment exist? How are unions and employers addressing the need for early intervention and an effective complaint resolution mechanism in collective agreements?
  • How has the increasing focus on worklife balance been addressed in collective agreement language relating to working conditions? What innovations exist in the areas of parental and family leave? Flexible working arrangements? Telecommuting? Job sharing? Dependant care?
  • With mandatory retirement having been abolished in many provinces, and with others likely to follow suit, what contractual terms are being negotiated regarding pre-retirement (early retirement, reduction of workload, etc.) and post-retirement (pension and benefits)?
  • What are the latest clauses dealing with job security (contracting out, job-sharing, protection against layoff due to restructuring in the private sector, and privatization in the public sector, etc.)?
