THE ISSUES:

Some of the questions to be addressed:

  • What is “psychological harassment”? Are the following included: Bullying? Foul language? Threats? Gossip? Deliberate isolation? Unfair distribution of workload? Denial of privileges?
  • What distinguishes harassment from poor management? Insensitivity? Uncooperative personal relations?
  • Is a single incident enough to constitute harassment? Or is repetitive behaviour an essential feature?
  • How should employers respond when psychological harassment occurs? How should it affect their response if the harasser is a manager or supervisor as opposed to a fellow employee? Should zero tolerance or progressive discipline? (e.g. damages? cease-and-desist orders? training directives? physical separation of victim and harasser, etc.) be preferred?
  • What responsibilities do employers have to protect employees from psychological harassment? How does one recognize and identify signs of psychological harassment in the workplace? What steps should employers take to prevent psychological harassment?
  • What laws apply to control workplace harassment and penalize the perpetrators? What legal remedies are available from courts, arbitrators or tribunals? How effective is Quebec’s new legislation?
  • What liability does an employer bear for psychological harassment by supervisors or co-workers? In a lawsuit over workplace harassment, what defences are available to employers?
  • What are the elements of a “best practice” policy in respect of bullying and psychological harassment at the workplace?
  • What obligations do unions have in situations involving workplace harassment?
