THE ISSUES:

Some of the questions to be addressed:

A panel of prominent human rights experts, with widely varying perspectives, will debate the pros and cons of the Ontario government’s proposed amendments in Bill 107 to the Human Rights Code (abolishing the investigation and screening function of the Commission and allowing complainants direct access to the Human Rights Tribunal). Questions addressed will include:

  • How will the proposed changes affect:
    • the time lapse between filing a complaint and a determination by the Tribunal (now 5 years)?
    • the backlog of complaints?
    • the number of cases proceeding to a hearing?
    • the cost of pursuing and responding to a complaint?
    • the obligations and potential liabilities of unions?
    • the response to systemic discrimination?
    • procedural fairness? opportunities for appeal?
    • the range of remedies ordered by the Tribunal?
    • access and resort to the courts in human rights disputes?
    • penal sanctions for violations of the Code?
  • What has been the experience in B.C. where the Human Rights Commission was abolished, and all complaints are referred to the Human Rights Tribunal?
