| THE
ISSUES: | Some
of the questions to be addressed:
- Which rules require employee or union consent? Which can be unilaterally imposed? Do rules and orders have to satisfy a test of reasonableness?
- What does insubordination encompass? Is it limited to refusing to follow a specific rule or a direct order? What about insolent, disrespectful, insulting comments towards management?
- In most cases an employee must obey an order, and grieve its propriety afterward, but there are exceptions to the “work now, grieve later” rule. In this regard, when can employees
- refuse to provide medical information or submit to a medical exam?
- leave work without permission?
- refuse to (a) comply with a dress code or uniform, (b) modify their clothing or remove facial or body adornments, (c) trim their hair or shave off a beard, moustache or sideburns?
- decline to be vaccinated against flu or hepatitis?
- decline a work assignment that they do not consider part of their job because it is arguably contrary to the collective agreement?
- refuse work they consider unsafe or dangerous?
- disobey an order not to publicly criticize the employer, employer policies or working conditions?
- refuse to co-operate in an employee investigation of another employee?
- decline to answer questions or make a statement in an investigation of their own conduct?
- What can union representatives or officers say or do that other employees cannot without breaching the rules against insubordination?
- What types of sanctions do arbitrators consider as appropriate for different forms of insubordination? What circumstances are regarded by arbitrators as mitigating factors?
