ISSUES:

Recovering from a crippling physical or psychological disability is challenging enough without having to worry about where your next pay cheque is coming from. In this special audio conference focusing on benefits for disabled workers, Lancaster's team of expert practitioners will tackle the complicated questions arising from coordinating benefits and pay for employees forced to draw on their short- and long-term disability benefits. Topics will include:

  • What is the relationship between disability insurance benefits, workers' compensation benefits, sick pay, and other entitlements?

  • Return to work: Who pays the disabled employee's wages and benefits during a graduated return-to-work program?
  • Access to extended health, retirement, vacation time/pay, severance, and other benefits: What are the rights of employees absent on disability leave?
  • Are collective agreement provisions relating to disability plans amended by the insurance policy or the insurer's rules? Can the eligibility and coverage provisions in disability plans be changed without the union's or employee's consent?
  • What recourse is available to employees whose benefits are terminated by the insurer?
  • What effect does the insurer’s determination regarding 'total disability' and other matters have on the employer's, union's and employee's obligations in the accommodation process?
  • Arbitrability of disputes between the insurer and the employee: When, if ever, can the employee sue an insurer in court?
  • When can the employer terminate employment in order to force the disabled employee to access government and other disability pension benefits?
  • The union's obligations: Are collective agreements that exclude employees absent on LTD from collecting certain benefits, discriminatory?
