Responding to popular demand, Lancaster House presents its first-ever audio conference focusing on the common law governing employment in non-unionized workplaces, including wrongful dismissal, employment contracts, and more. Our panel of expert practitioners will canvass the hottest new developments in the common law of employment, including:

  • Discipline in the common law setting: When does misconduct constitute just cause for dismissal? Can executives be suspended for misconduct? What must the employer do before dismissing an employee for poor performance?

  • Non competition and solicitation agreements: When are they enforceable?
  • Constructive dismissal: When does a demotion amount to constructive dismissal? Elimination of key responsibilities? Changes in compensation and bonuses? Can harassment or office conflict support a constructive dismissal claim?
  • Wrongful dismissal damages update: What do the latest cases say about Wallace damages, damages for mental distress, and punitive damages? When are human rights and privacy violations actionable?
  • What effect has the legislative abolition of mandatory retirement had on the common law?
  • Mitigation update: When will an employee's actions constitute a failure to mitigate? Are Wallace awards, aggravated and punitive damages subject to mitigation? Does the duty to mitigate require workers to accept lower-paying jobs, or jobs with the dismissing employer?
