ISSUES:

The last year has seen an explosion of new case law concerning the accommodation of family and parental responsibilities in the workplace. In this 90-minute session, Lancaster brings together a panel of expert practitioners to answer your questions about this rapidly evolving area of labour and employment law. Topics will include:

  • What constitutes discrimination on the basis of family status? What obligations do employers have to accommodate workers' familial obligations? Can workers insist on particular hours of work, shifts, or part-time hours based on child care or other family responsibilities?

  • Pregnancy, maternity, parental and adoption leave: What are the parties' obligations under employment standards legislation? When will a failure to re-employ a worker returning from such leave be found discriminatory or unjust? Are employees on such leaves entitled to benefits, pension contributions, vacation and sick leave accrual? Can collective agreements legally give male and female parents, or biological and adoptive parents, different leave entitlements?

  • Accommodating pregnancy: When are pregnant employees entitled to sick leave? What duty do employers have to accommodate pregnant employees? When can pregnant employees refuse unsafe work? Can employers reassign pregnant employees based on safety concerns? 

  • Compassionate care, emergency leave, and family responsibility leave: What statutory entitlements do workers have in different jurisdictions? When collective agreements provide for family or emergency leave, when can employers refuse to grant such leave? How are such absences to be counted?
