ISSUES:

A fundamental freedom in every democracy, the individual's right to freedom of expression has important labour law aspects. A number of recent court, arbitral and human rights tribunal decisions indicate that freedom of expression is emerging as a new platform for expanding employee and union rights. In this session, a panel of experts will analyze the latest developments in this burgeoning area of human rights law:

  • The individual's right to freedom of expression in the workplace: Where does it come from? What does it protect? In what circumstances have arbitrators recognized an employee right to freedom of expression in public and private sector workplaces? Is there a common law right to freedom of expression in the workplace, and if so what are its limits?

  • Limits on the individual's right to freedom of expression in the workplace: When are employers justified in disciplining or dismissing employees for political involvement, running for public office, volunteer work, public involvement with charities or religious causes? When do dress code policies violate the employee's right to freedom of expression?

  • Public criticisms of the employer and whistleblowing: When will freedom of expression justify an employee's disclosure of information concerning the employer or its operations? When is the employer entitled to discipline or dismiss a so-called whistleblower?

  • Union organizing, the right to strike, leafleting, informational pickets: What does the freedom of expression protect? In which circumstances are political demonstrations and leafleting  allowed during the life of a collective agreement? When is secondary picketing (i.e. picketing allies of the struck employer) protected by freedom of expression? When does an informational picket cross the line and become an illegal strike?
