ISSUES:
When an employee is charged with or convicted of a criminal offence, employers and unions face difficult choices, especially where the conduct did not occur at work but may nonetheless impact on the workplace. This panel will explore the many problems which can arise where a criminal investigation parallels a workplace disciplinary inquiry, including:
- When is an employee obliged to disclose criminal charges and/or a conviction arising from off-duty conduct? When can employers do criminal record checks as part of the hiring process?
- When is it appropriate to suspend an employee who is under criminal investigation or who has been charged with a criminal offence?
- When will off-duty criminal conduct merit a disciplinary response? Or non-disciplinary termination?
- What issues arise when employees are convicted of driving offences?
- What effect do criminal charges have on workplace investigations, disciplinary proceedings and grievance arbitration? Can employees subject to criminal investigation invoke the right to remain silent vis-à-vis their employer? Are they compelled to cooperate with an employer investigation?
- Does incarceration due to criminal conviction automatically justify the termination of employment? When may employers be required to grant a leave of absence and/or participate in a temporary absence program permitting an employee to attend work while in jail?
- How does the prohibition against discrimination based on criminal record, in the Charter and human rights legislation, affect an employer's course of action?
