ISSUES:

By popular demand, Lancaster House brings together a panel of experts to update listeners on the most recent developments in the outer limits of the law of accommodation. In this special advanced session, our panel will focus on current approaches to the most difficult issues generated by the duty to accommodate, including:

  • What factors can an employer take into account in determining whether accommodative measures would cause undue hardship? Only those listed in human rights legislation? Or such concerns as productivity, operational efficiency, effect on morale and/or impact on collective agreement rights?
  • Is an employer required to accommodate an employee who fails to identify a disability and/or to request accommodation, or even denies a disability?
  • How far does the employer have to look beyond an employee's original job in order to fulfill the duty to accommodate? When will it be required to bundle duties, reassign duties from other employees or create special light-duty positions?
  • Does the duty to accommodate require employers to tolerate absenteeism or below average productivity? Adjust hours of work?
  • When can the employer hold a disabled worker out of service or refuse a proposed accommodation on safety grounds? Are employees entitled to assume risk?
  • Can collective agreement provisions be "waived" in the search for accommodation? How should the union balance its duty of fair representation to the bargaining unit as a whole with its obligation to facilitate the accommodation of disabled workers? 
  • To what extent are employees required to cooperate with the accommodation process? Must employees participate in treatment? Can employers hold employees out of service or terminate for not facilitating accommodation?
