ISSUES:
The law governing employee drug-testing is changing rapidly, in pace with developing technology, especially in safety-sensitive workplaces and for safety-sensitive positions. A panel of experts will discuss the latest decisions on the issue, including:
- Is drug testing more reliable these days? Can drug tests measure impairment? Are "less intrusive" tests like cheek swabs acceptable to courts and arbitrators?
- Can employers institute a workplace policy that requires mandatory self-disclosure, i.e. that employees disclose a drug addiction?
- In what circumstances is drug testing of present and prospective employees permitted? In this regard, what recent legal changes have taken place?
- Is random drug testing now permissible? Does it depend on whether the position, workplace or industry is safety-sensitive? Must a history of drug-related problems be demonstrated? Is pre-access testing acceptable even where on-the-job testing is not?
- Can casual users be tested? For cause or randomly? Must employees who are casual users be treated differently than drug-dependant employees? What about employees who fail to disclose their condition?
- In the event of a positive test or refusal to take a test, can an employee be disciplined or discharged? When does drug addiction, or failure to pass a test, require accommodation?
- With respect to pre-access and pre-employment testing, and the testing of casual users, how should the parties deal with conflicting court decisions, e.g. Chiasson (Alberta) versus Entrop (Ontario)?
