ISSUES:

The right to impose discipline for the breach of workplace policies and procedures, or for misconduct contrary to the best interests of a workplace, is a central management right. However, the scope of what action can be taken by an employer to impose discipline on employees becomes less certain when conduct relates to workplace health and safety, which is subject to a separate regulatory regime. In this session, counsel with experience in both health and safety and labour relations law will consider the issues which create challenges in this area, and provide some guidance on issues such as:

  • When can an employer discipline employees for the breach of workplace rules or procedures which relate to safety?
  • Is an employer obliged to impose discipline in order to meet the standard of due diligence?
  • Does the principle of progressive discipline apply when imposing sanctions for safety infractions?
  • What mitigating factors, if any, should be taken into account in assessing discipline for the breach of safety rules?
  • What is the difference between a work refusal and insubordination? When, if ever, can discipline be imposed for a work refusal? What will constitute a reprisal contrary to health and safety legislation?
