When it comes to employee sick leave, what can the employer ask? What is the employee required to tell? And what is the union entitled to know? Let our experts guide you through the latest developments in legislation and case law. Topics to be canvassed include:

  • Must an employee disclose a medical diagnosis in order to obtain sick leave? When can employees be required to provide medical certificates? What is an employer entitled to do when the medical certificate is inadequate?
  • What kind of inquiries are employers allowed to make into the claimant's treatment? Can employers solicit information about the employee's physical and cognitive restrictions and non-medical barriers to recovery?
  • Can employees "moonlight" while on sick leave or LTD?
  • What kind of investigation into the legitimacy of sick leave and LTD claims is permissible? When is surveillance justified? Where an insurer refuses to cover an LTD claim, can the employer be held responsible?
  • Do sick leave credits, seniority, and benefits accrue while an employee is on occupational injury or sick leave?
  • Are collective agreement provisions relating to disability plans subject to the terms of insurance policies? Can the eligibility and coverage provisions in disability plans be changed without the union's or employee's consent?
  • Can employment be terminated while the employee is on LTD?
