ISSUES:
Lancaster House brings you a special audio edition of our perennially popular Major Case Law Update. Leading labour and management counsel will discuss the most significant court decisions of the past year dealing with critical issues in labour and employment law, as well as what's coming up for determination during the current year.
Cases to be discussed include the following:
- The limits of the employer's duty to accommodate: Hydro-Quebec v. Syndicat des employé-e-s de techniques professionnelles et de bureau d'Hydro-Québec, section locale 2000 (SCFP-FTQ) (Supreme Court of Canada)
- Damage awards for mistreatment of employees: Honda Canada Inc. v. Keays (Supreme Court of Canada); Piresferreira v. Ayotte (Ontario Superior Court of Justice)
- The legality of mandatory retirement under bona fide pension plans: New Brunswick (Human Rights Commission) v. Potash Corporation of Saskatchewan Inc. (Supreme Court of Canada)
- The changing standard of proof in labour arbitration cases: F.H. v. McDougall (Supreme Court of Canada)
- The expanding meaning of freedom of association in the Charter of Rights: Confédération des syndicats nationaux v. Québec (Procureur général) (Quebec Superior Court); Fraser v. Ontario (Ontario Court of Appeal)
- The new rules for judicial review and due process: Dunsmuir v. New Brunswick (Supreme Court of Canada)
- Panelists will alert listeners to the issues involved in employment and labour law cases which will be heard and decided imminently by the Supreme Court of Canada.
