Cases to be discussed include the following:

  • Damage awards for mistreatment of employees: Honda Canada Inc. v. Keays (Supreme Court of Canada); Piresferreira v. Ayotte (Ontario Superior Court of Justice)
  • The legality of mandatory retirement under bona fide pension plans: New Brunswick (Human Rights Commission) v. Potash Corporation of Saskatchewan Inc. (Supreme Court of Canada)
  • The changing standard of proof in labour arbitration cases: F.H. v. McDougall (Supreme Court of Canada)
  • The expanding meaning of freedom of association in the Charter of Rights: Confédération des syndicats nationaux v. Québec (Procureur général) (Quebec Superior Court); Fraser v. Ontario (Ontario Court of Appeal)
  • The new rules for judicial review and due process: Dunsmuir v. New Brunswick (Supreme Court of Canada)
  • Panelists will alert listeners to the issues involved in employment and labour law cases which will be heard and decided imminently by the Supreme Court of Canada.
