Several of the labour boards across Canada are mandated to adjudicate a range of workplace disputes which do not arise from the core collective bargaining statutes, including employment standards and occupational health and safety appeals. In this interactive workshop a panel of adjudicators and counsel will discuss the differences in procedure relevant to the adjudication of these disputes, significant case law concerning the scope of the boards’ jurisdiction, and best practices for appearing on these matters. A fact situation and problems will facilitate hands-on learning in a small-group setting. Some of the issues to be discussed include: |
|
|
| |
The rules and processes relevant to occupational health and safety and employment standards appeals |
| |
|
| |
The enforcement of other workplace statutes by labour boards |
| |
|
| |
Key decisions which outline the scope of the boards’ jurisdiction |
| |
|
| |
The special role played by other parties in these proceedings, including government counsel, lower-level decision-makers, officers, etc. |
| |
|
| |
Tips for working with self-represented complainants and respondents, for adjudicators and counsel |
