This workshop, led by experienced arbitrators and counsel, is designed to provide you with tips on how to effectively prepare and present your case at interest arbitration and to decide whether and how to use modified arbitration processes, including med/arb and final offer selection. Attendees will hear about tactics and strategies that work, as well as common pitfalls to avoid in these processes. Topics covered in this workshop include:

Interest Arbitration:

  • Establishing ground rules
  • Setting priorities
  • Researching and preparing the brief
  • Marshalling evidence and documentation
  • Assembling economic and total compensation data
  • Selecting arbitrators and nominees
  • Presenting the brief
  • Communicating fallback and bottom-line positions

Med/Arb:

  • Considering at the outset whether mediation could settle the dispute
  • Assessing whether med/arb should be selected
  • Preparing for med/arb
  • Deciding whether and what to "keep to give something away" at mediation
  • Sizing up the neutral
  • Interacting with the neutral

Final Offer Selection:

  • Assessing the risks of final offer selection
  • Deciding whether the selection should be on a package or issue-by-issue basis
  • Assembling a package
